1. Acceptance of Terms
By accessing or using the CED Hub Progressive Web App (the "App"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree with these Terms, you must not use the App. Your continued use of the App signifies your acceptance of these Terms.
2. Provided "As Is"
The App is provided on an "as is" and "as available" basis. Select Oklahoma, the provider of the App, makes no warranties or guarantees, express or implied, regarding the performance, availability, reliability, or suitability of the App for any particular purpose. Use of the App is at your own risk.
3. No Warranty
Select Oklahoma disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Select Oklahoma does not warrant that the App will be error-free, uninterrupted, secure, or free from viruses or other harmful components.
4. Limitation of Liability
Under no circumstances shall Select Oklahoma be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the App, including but not limited to any loss of data, loss of profits, or loss of business opportunities, even if Select Oklahoma has been advised of the possibility of such damages.
5. Digital Communications and Interactions
The App facilitates digital communications and interactions between users. Select Oklahoma does not monitor, filter, or control these communications. You acknowledge that you are solely responsible for your interactions and communications through the App. Select Oklahoma shall not be held liable for any harm, injury, or damages resulting from your use of the App's communication features.
6. User Responsibility
You agree to use the App in compliance with all applicable laws and regulations. You are solely responsible for any content you share, post, or transmit through the App. Select Oklahoma reserves the right, but is not obligated, to remove any content that violates these Terms or is otherwise objectionable.
7. Indemnification
You agree to indemnify, defend, and hold harmless Select Oklahoma, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or any violation of these Terms.
8. Changes to Terms
Select Oklahoma reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
9. Privacy and Information Security:
We are committed to protecting your privacy. Information collected through this document or associated communications are not released, shared, or sold to third parties without consent, except as required by law.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Oklahoma.
11. Opt-In Agreement
By opting in to use the CED Hub App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
